How to obtain Spanish nationality by residence

All foreigners who have been legally in Spain for at least two years are entitled to apply for and acquire Spanish nationality. All those who qualify, must begin the process by passing two exams CCSE (constitutional and sociocultural knowledge of Spain) and DELE (Spanish language proficiency). Citizens of Spanish-speaking countries are exempt from the latter exam. The CCSE consists of 25 true/false questions and it is possible to find open calls every month of the year except for August and December. It costs 85 euros and the certificate issued is valid for four years.

There are several ways to submit the residency application:

- Through the Public Registry.

- Through the Common Electronic Registry.

- By Electronic Registry of the Ministry of Justice.

- By postal mail.

- Through the digital platform of the Ministry of Justice.

You must submit the following documents:

- Duly completed application form.

- Birth certificate from the country of origin legalized and translated (the latter, only in case it is in a language other than Spanish)

- Copy of the valid passport. ‍

- Legalized criminal record certificate from the country of origin. ‍

- Copy of the current valid residence card.

- Additional documentation:

- Employment contract

- Health card.

- Internship agreement, etc.

- CCSE and DELE certificates approved.

- Payment of the administrative fee 790 code 026

‍After you have submitted your application and it has been received by the Ministry of Justice, it will be assigned a file number with which you can review its status. In this review, different statuses may appear:

- Open

- in process.

- Pending request for official mandatory reports

- Pending receipt of official mandatory reports.

- In process

- Required (only in case the Ministry of Justice has requested additional documentation to that previously stipulated).

- Under study / under qualification

- Granted / denied.

The Ministry of Justice will notify you of the decision of the application within a maximum of 180 days. If your application has been accepted and you are granted the nationality, you will have to take the oath or promise of Spanish nationality in front of the Civil Registry official closest to your home. In this you will have to swear fidelity to the King, obedience to the Constitution and the Laws, your resignation to your previous nationality and your commitment to register in the Spanish Civil Registry. 

Once this ceremony has been carried out, the next step is to process your Spanish birth certificate with which you will be able to process some other important documents such as your passport, your National Identity Card and the Certificate of Concordance.
